Mandurah Boat Hire Pty Ltd is the operator of Mandurah Boat Hire.

General Terms

All hirers release Mandurah Boat Hire for any claim whatsoever and howsoever incurred including but not limited to a claim for death, bodily injury, damage or loss of property during embarkation and/or disembarkation to or from the vessel and/or at all times whilst onboard the vessel itself, except to the extent death, bodily injury, damage or loss of property has been caused or contributed to by the negligence of Mandurah Boat Hire.

We reserve the right to refuse the hirer if we believe you to be intoxicated or under the influence of substances.

If the hire is cancelled for any reason by us, including unfavourable weather conditions or mechanical issues then we will reschedule your booking for a future time if availability allows or offer you a full refund. 

Pricing Policy

All prices are in Australian Dollars (AUD) and include GST. Mandurah Boat Hire reserves the right to alter the prices at any time. Eftpos transactions will incur a 1.5% transaction fee.

Payment and Cancellation Policy

All cancellation requests must be in writing to [email protected]. Calling, leaving an answerphone message or speaking to the team in person is not an acceptable form of cancellation.

Our policies allow changes, but also reflect the fact that Mandurah Boat Hire may lose the opportunity to sell hires or incur costs if short notice of cancellation is given. Bookings cancelled within 7 days will be offered the opportunity to reschedule only. If the hirer arrives after the hire time has commenced the hire time will be shortened to and you are expected to still return at the end of the original hire time.

There are no refunds or credits available for change of mind and prematurely ending the hire.

There are no refunds available for any cancellations to our “night time hire”. We can offer a voucher for a day time hire with a 1 year validity if 14 days notice is given, we may allow rescheduling at our discretion if availability allows and 7 days notice is given.

Cancellation due to a COVID lockdown or a customers inability to travel will be subject to manual review by us. In the event the customer has abided by all testing and vaccination requirements we will consider a refund at our discretion.

Christmas Lights Cruises, 1.5 hour Sunset and Christmas lights Cruise and White Pearl Private Hire

There are no refunds available for any cancellations to our “Christmas Lights Cruises”. We can offer a voucher for a day time to be used with a 1 year validity if 14 days notice is given, we may allow rescheduling at our discretion if availability allows. Rescheduling your scheduled departure date is not allowed once tickets for your cruise are 80% sold.

Private bookings are subject to a non-refundable deposit to be secured. Discounts, specials, promotions and third party offers cannot be applied to existing bookings. There can be no changes made to private hires inside of three months this is due to the fact that we lose the ability to sell seats or other private hires.

For refunds on tours that are booked with a credit card, the credit card and online booking fees will not be refunded. Bookings made through third party booking agency's may be subject to additional cancellation fees.

Missing Your Hire

Please arrive at our booking office at least 15 minutes prior to your scheduled hire time. If you arrive after this time, we reserve the right to shorten your hire time. We will not offer refunds if you do not show up for your hire or offer rescheduling.

Passenger Limits

The stated passenger limits are a maximum allowed including all children. This is a legal passenger limit and must be adhered to at all times. If you miscalculate the number of passengers we will not offer a refund or reschedule at the last minute, you will only be able to board the maximum number of passengers.

If your hire includes a tour guide then they will be using one seat, this means if you book a 12 seater with a tour guide, the maximum number of passengers allowed is 11.

During Your Hire

Never put your arms or legs over the railings or through the gaps in the side of the vessel. Never sit on the railings or gates. The hirer will not exceed the speed limit. If we have to come to your aid you will be charged a fee based on how far you are from the booking office. Minimum charge of $50 applies.

COVID-19 Pandemic

Passengers must abide by government guidelines and follow any self quarantine advise and sign in using the safe W.A app or paper register at the office.

If we are concerned for our staff members health and safety we reserve the right to cancel all hires. We will follow all government guidelines of operation relevant to our business. Management have completed the COVID-19 Hygiene officer course provided by the government.

Our cancellation policy on our hires remains the same during this time. Please note that if you're unable attend because of a government restriction targeting unvaccinated people then you may forfeit your right to a refund.

Cleaning

If you make an unreasonable mess on the vessel we reserve the right to charge you a minimum of a $150 cleaning fee.

Damage

You will be held liable for any damage caused to the vessel if your actions are not considered fair use or general wear and tear.

Additional Costs

You are liable for all damage to our vessels and 3rd party vessels. Here is a list of potential costs you may be liable for:

  • Loss of anchor and chain: $100
  • Recovery fee if you run aground $25 per km from our office, minimum charge of $50.
  • Damaged propeller caused by running aground or hitting rocks: $150
  • Damaged gearbox caused by running around or hitting rocks: $1,500
  • Damaged bimmi roof from climbing on the roof or collision: $250-$1000
  • Smashed or cracked windscreen: $500
  • If we have to come out to you in an excluded zone such as the ocean, $25 per km, minimum charge of $50
  • Excessive mess cleaning fee: $150

Mandurah Boat Hire is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.

This Personal Information is obtained in many ways including interviews, correspondence, by telephone and by email, via our website www.pirateshipmandurah.com.au, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.

We collect your Personal Information for the primary purpose of providing our services to you. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

  • For a secondary purpose that is directly related to the primary purpose

Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.

Access to your Personal Information

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

Mandurah Boat Hire will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is an important to us that your Personal Information is up to date. We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
