Terms & Conditions
These Terms & Conditions apply to every hire with Mandurah Boat Hire, a trading name of Boat Hire Mandurah Pty Ltd (ABN 44 653 185 605) ("MBH"). By booking or hiring, you and everyone in your party ("your party") agree to them. Separate Liability Waiver terms also apply and must be read and signed by the hirer before departure.
Eligibility & Licensing
- The hirer and skipper must be at least 18 years of age on the day of the hire.
- Daytime hires operate under the Western Australian hire-and-drive arrangement, so a Recreational Skippers Ticket (RST) is not required, provided the vessel is operated in daylight, within the permitted hire area, and after completing our safety briefing.
- Vessels may only be operated between sunrise and sunset unless the skipper holds a valid RST. Night hires (including Christmas Lights cruises) require the skipper to hold and physically produce a valid RST before departure.
- The inducted skipper is the only person permitted to operate the vessel and must not allow any other person, including children, to do so. The skipper must not leave the helm unless the vessel is stationary.
Safety & Conduct
- All hirers must complete the liability waiver and a full safety briefing (video and/or in person) before departure. You must not depart our jetty until every member of your party has received the full safety briefing and understood the instructions given.
- Safety briefings commence at your scheduled hire time and are included in the hire period. Watching the safety video in advance will reduce this time.
- An approved lifejacket must be available for every person on board and must be worn where required by Western Australian law, including by children while the vessel is underway and at any time of heightened risk. The hirer is responsible for ensuring compliance.
- Skippers and anyone operating the vessel must not be affected by drugs or alcohol. A zero-tolerance policy applies and the legal blood-alcohol limit for operating a vessel in WA must not be exceeded.
- You must observe all speed limits, remain within the permitted hire area, and keep out of prohibited zones and the open ocean.
- The licensed capacity displayed on the vessel is the maximum number of people permitted on board, including adults, children and infants, and must not be exceeded.
- Smoking is prohibited on all vessels. Passengers must not place limbs over the vessel's sides, sit on railings, climb on roofs, or tow other vessels.
- Mobile phones must remain on and audible throughout the hire.
- Swimming is at your own risk. Engines must not be running while anyone is in the water, and re-boarding can be physically challenging.
- You confirm that you and your party are physically and mentally fit to take part and can swim to a reasonable standard.
- You must follow all reasonable directions from our staff and from marine and other authorities.
Fishing, Environment & Wildlife
- Fishing and crabbing are permitted only on designated vessels, and at least one person on board must hold a valid Recreational Fishing from Boat Licence. You are responsible for complying with WA fisheries regulations; MBH accepts no liability for any breach.
- You must not approach, chase, feed or harass wildlife, and must keep well clear of dolphins in the Peel-Harvey Estuary.
- You must not discharge rubbish, fuel or waste into the water.
Vessel Care & Cleaning
- Vessels must be returned in a clean condition. Excessive mess will incur a cleaning fee.
- You are responsible for any missing, lost or damaged equipment and for all associated costs.
- Damage, recovery and other charges, and the security bond, are set out in the Liability Waiver you sign before departure.
Termination of Hire
MBH may terminate a hire immediately and without refund for: failure to comply with these terms or the law; threatening or abusive behaviour toward staff; unauthorised use, overloading, or operating outside the permitted area; reckless conduct (including speeding, erratic or dangerous operation, chasing wildlife, or climbing outside the vessel); or the skipper consuming alcohol or drugs, or passengers being excessively intoxicated.
Booking & Payment
- Please arrive at least 15 minutes before your scheduled hire time and check in at the office. If you arrive after your scheduled time, your hire will be shortened accordingly, with no refund. If you return the vessel before the end of your booked hire period, the remaining time is forfeited and no refund or credit is given for the unused time.
- EFTPOS transactions incur a 1.6% processing fee.
- A refundable security bond may be required. Where you book online, you authorise us to place a pre-authorisation hold for the bond on the card used to book; full details are in the Liability Waiver.
- Private bookings are subject to a non-refundable deposit.
- Discounts, specials, promotions and third-party offers cannot be applied to existing bookings.
- All prices are in Australian dollars and include GST.
Cancellations & Rescheduling
- All cancellations must be submitted in writing to office@boathiremandurah.com.au. Verbal cancellations, in person or by phone, are not accepted.
- Bookings cancelled within seven (7) days of the hire date but more than 24 hours beforehand may be rescheduled subject to availability but are not eligible for a refund.
- No refunds are available for cancellations or no-shows for night-time hires or Christmas Lights Cruises. Vouchers valid for one (1) year may be offered for cancellations with more than fourteen (14) days' notice.
- No rescheduling or refunds are permitted for Christmas Lights hires and cruises.
- MBH may cancel or reschedule a hire in the event of adverse weather, unsafe conditions, or mechanical issues, and may offer a reschedule or refund at management's discretion.
Privacy & Monitoring
- MBH may record or monitor activity on board for safety, compliance and liability purposes. By hiring, you consent to this monitoring.
- MBH handles personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information collected (such as name, address, email and phone number) is used to provide our services and communicate with you. - Our website uses cookies and similar technologies to operate the site, measure traffic and understand how our advertising performs. This includes analytics and advertising services provided by third parties such as Google and Meta, which may set cookies and receive information about your visit, including limited booking details such as the value of a purchase, so we can measure the performance of our advertising.
